Second Child in China

My wife is Chinese I am UK citizen,our first child was born in the UK,she is UK Passport holder. Now we live in China,we have a second child due in May,will the second child be classed as the first under Chinas one child policy,or are we excempt anyway due to one being a foriegn national,or are we liable for a fine for breaking one child policy TIA for any help with this,if you have been through this

No, don't think you'll get fine. Usually this is applied to parents from mainland China.

I cannot speak with authority as I've never read the law, but none of my expat friends with Chinese spouses have ever had any problem with having more than one child. As you are from the UK, the law does not apply to your family. Anyone ever heard otherwise? Congratulations, by the way.

Hi, congratulations to you.

Since your first child was born overseas and is a foreign passport holder, your second child (presumably to be born in China based on your note above) will be considered the first child. At least that's how the authorities will classify him/her since it is the first time you are registering the child as a newborn locally.

Of course, best to check with the official authorities. But this is what I understand based on previous observations and also what we've seen from other local friends with more than one child.

Since your kids are not going to get registered on your wife's hukou, the one-child policy won't apply.

Unrelated, but make sure the authorities don't find out about your wife having a UK passport as China doesn't recognize dual citizenship.

I agree totally but the local office dont seem to know,and just keep saying not allowed with no recourse,and putting the phone down

Ok, but since your first child is not on your wife's hukou, you won't have any problems.
